Purpose
CallerHQ is an Android and iOS app that allows you to report telephone spam for review of potential legal claims and, where appropriate, connect with an attorney or law firm that may pursue those claims.
-
How the Service Is Provided
CallerHQ is provided by LawHQ Technology Services LLC (“LawHQ Tech”). LawHQ Tech is not a law firm and does not provide legal advice or legal representation. LawHQ Tech reviews spam you report through CallerHQ and related communications to help identify potential legal claims. In doing so, LawHQ Tech acts as agent for the law firm LawHQ, P.C.
-
Attorney-Client Relationship
By using CallerHQ, you form a limited-scope attorney-client relationship with LawHQ, P.C., located at 7533 S Center View Ct Ste R, West Jordan, UT 84084, for the purpose of reviewing and evaluating potential legal claims you raise in connection with CallerHQ, including spam-related claims and other legal issues you communicate. Communications in connection with CallerHQ are provided so your claims can be evaluated, and to determine whether they can be pursued. Because LawHQ Tech acts as LawHQ, P.C.’s agent in operating CallerHQ and receiving those communications, those communications and related materials are confidential and protected by the attorney-client privilege between you and LawHQ, P.C. This limited-scope relationship does not obligate LawHQ, P.C. to pursue any claim or take legal action for you. If your claims are later pursued by another attorney or law firm, you must first sign a separate attorney-client agreement with that attorney or law firm.
-
Using CallerHQ
LawHQ Tech only sees and reviews calls and text messages that you report as spam through CallerHQ.
If you enable the voicemail feature in CallerHQ, LawHQ Tech will transcribe and store your voicemails. LawHQ Tech only sees and reviews voicemails that you report as spam through CallerHQ or that LawHQ Tech has identified as spam based on aggregated data.
If you add your number to the National Do Not Call Registry through CallerHQ, you authorize LawHQ Tech to register your phone number on your behalf.
-
Network Counsel
To pursue your legal claims for telephone spam, LawHQ, P.C. works with other law firms and attorneys (“Network Counsel”). Before Network Counsel pursues legal action for you in a new legal matter, you must sign an additional attorney-client agreement (“Network Counsel Agreement”) with that attorney or law firm. If any term in a Network Counsel Agreement conflicts with these CallerHQ Terms, these CallerHQ Terms will control to the extent of the conflict.
-
Options for Pursuing Legal Claims
Network Counsel may pursue legal claims for telephone spam in various ways. These may include demand letters, individual lawsuits, class action lawsuits, individual arbitration, mass arbitration, or other methods.
-
No Guarantee
There is no guarantee Network Counsel will initiate legal action on your behalf. If there is any telephone spam for which you require or expect legal action to be taken, do not report it through CallerHQ. Instead, you need to seek other legal counsel.
-
Costs
There are no costs for using CallerHQ. If Network Counsel initiates legal action on your behalf, the Network Counsel Agreement will specify the fee or contingency arrangement.
-
Fee Sharing
LawHQ, P.C. will receive 15% of the fees earned by Network Counsel. LawHQ, P.C. assumes no responsibility for Network Counsel’s representation of your legal claims.
-
Age
You must be of legal age to contract under the laws of your state of residence.
